Cell C Travel SIM General Terms and Conditions
- It is important that you understand and agree to these terms and conditions ("Terms") before using the international travel SIM services and associated support services ("Services"), or Cell'Cs platform (
- In the event that you do not understand any of these Terms, please get in touch with Cell C (https://www.cellc.co.za/cellc/ContactUS) and Cell C will explain them to you. If you do not understand or agree to these terms and conditions, please do not continue using the Services. Your acceptance of these Terms shall constitute your agreement to be bound and comply with these Terms and other applicable terms and conditions as incorporated by reference to these Terms.
- These Terms apply to the Services that customers can access via the Platform.
- All prices advertised include VAT, unless otherwise stated.
- The Service is available for purchase to any customer who registers to access the Services on the Platform.
- In order to provide the Service to you, you acknowledge and give consent for Cell C to provide your information to AirGSM Pte Ltd (“Airalo”), a third-party service provider of Cell C responsible for arranging, operating and maintaining the Service, who will process your personal information in order to provide the Services. Please ensure that you read and understand Airalo 's privacy policy and cookies policy, which can be accessed at: https://www.airalo.com/more-info/privacy-policy and https://www.airalo.com/legal/cookie-policy respectively.
Use of your Personal Information and Direct Marketing
- You warrant and guarantee that all personal information supplied by you to Cell C is true and correct.
- By accepting these Terms, you understand and acknowledge that Cell C, its affiliate companies, service providers, suppliers and partners (“Group”) are required to comply with the provisions of the Protection of Personal Information Act of 2013 (“POPIA”) and other data protection legislation applicable in other jurisdictions at which you will be accessing the Services to, amongst other things, ensure the privacy and confidentiality of your Personal Information, as such term is defined in the POPIA.
- For purposes of rendering the Services to you by Cell C, you confirm, agree, understand, acknowledge that by accepting these Terms, –
- you disclose and provide your Personal Information to the Group voluntarily and consent and authorise the Group to collect, use, process, share and/or transfer your Personal Information in accordance with Cell C’s Privacy Policy (https://www.cellc.co.za/cellc/static-content/PDF/PrivacyPolicy.pdf) and Airalo’s privacy policy stated under clause 7 above, as may be amended by Cell C and Airalo from time to time.
- you agree to immediately inform the Group in writing if there is any change of whatsoever nature in any of your Personal Information previously supplied to the Group; and
- you agree and consent to be bound by the terms and conditions of the Privacy Policy, which you have read, understood and agreed to as part of your application for the Service.
- In order to fulfil the obligations set out in these Terms, Cell C will process your personal information. Such processing may include sharing personal information with the Group, but only to the extent necessary and in order to provide the Service to you.
- As and when necessary, you agree and consent to be contacted by Cell C or the Group in respect of their direct marketing campaigns in relation to similar and/or related products and/or services, which contacts will be in accordance with the terms and conditions of the direct marketing provisions of the Consumer Protection Act, 68 of 2008 (“CPA”) as amended, the CPA regulations and POPIA, including the provisions relating to the direct marketing registry.
- You can request Cell C to stop contacting you for marketing purposes (opt-out) at any time by sending your request to Cell C https://www.cellc.co.za/cellc/ContactUS. You may register a block on marketing from the Group on the forestated contact details.
- You are entitled to withdraw your consent for using your personal information under clauses 10 and 12 above, on written notice or notice in any other recorded form to Cell C. In the event you decide to withdraw your consent, the Group will not be able to use your information for the purposes listed under clauses 10 to 12 to the extent that you withdraw your consent from the date on which your withdrawal notice is received.
Intellectual Property Rights
- All intellectual property rights in the Platform and Services are owned by Airalo and Cell C. This includes copyright (including in our software), trademarks, know-how, trade secrets, and the design, compilation, and look and feel of the Platform, (together, the “intellectual property rights”). In using the Platform and Services, you agree to do so only for their intended purpose, and in accordance with these Terms.
General
- Cell C may amend, modify or otherwise change these Terms in its sole and absolute discretion and the amended version will be displayed in the same media as these Terms. By continuing to participate in and/or purchase the Service, you agree and understand that you will be bound by the amended terms and conditions.
- The Service and Platform are provided on an as-is and as available basis. In particular, Cell C does not guarantee that the Service and Platform will be available at all times, nor the quality of the underlying connections and networks. To the extent permitted by law, Cell C excludes all implied conditions, warranties, representations or other terms that may apply to the provision of the Services and the Platform.
- Cell C and/or any of its agents, directors, affiliates, members, employees, subcontractors or service providers shall not be responsible in any way for claims, loss or damages (either direct, indirect, consequential or otherwise), arising from customers' use of the Service. Cell C shall not be held liable in the event that, for any reason whatsoever, the Service is not available or you experience any technical issues arising from your use of the Service.
- To the extent permitted by law, you will indemnify the Group, including our directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of our services or violation of these terms.
- Cell C has the right to withdraw or shorten the duration of the Service in its sole and absolute discretion and will notify customers if it chooses to do so. Customers will not have any claim against Cell C of any nature in the event of any adjustments in relation to the Service of the Platform.
UNENFORCEABILITY PROVISIONS
- If any term of these Terms is unenforceable, illegal, void, or contrary to public policy then it shall be deemed as deleted from these Terms. The remaining provisions of these Terms shall however remain binding and in full force.
Your Device
- In order to access our Services, you should have an unlocked, eSIM-compatible device, for which you should be the sole responsible user.
Your Account
- Your account is personal to you and cannot be assigned or transferred to anyone else without Cell C’s prior written approval. We reserve the right to suspend or terminate your account at any time, at our sole discretion. This can occur in situations where, for example, we have a security concern or if we think you have breached our Terms. We will notify you if we do this. Where you have breached our Terms or used the Services in a manner that is contrary to our Acceptable Use Policy, you will not be entitled to a refund, and we may suspend or terminate your Service Provider Account.
Refunds
- You can find more details about the circumstances under which you are entitled to a refund in our Refund Policy which are included in these Terms.
Termination and Suspension
- We select the best and most trusted service providers to work with, so that you can have the most reliable experience possible. This means that, at times, we might need to stop collaborating with a service provider where they do not meet the standards we expect. This can result in the termination or suspension of the Services that have been purchased by you. Where this happens, please refer to the Refund Policy for further information.
